Extended Warranty Terms

EXTENDED LIMITED WARRANTY

This Extended Limited Warranty Agreement ("Agreement") is entered into by and between National Protection Company, LLC ("Provider") and the purchasing customer ("Customer") as of the date of product purchase. By purchasing this Extended Limited Warranty, Customer acknowledges that they have read, understood, and agreed to the terms and conditions set forth in this Agreement.

1.  TERM; LIMITED WARRANTY PERIOD EXTENSION OPTIONS:

a.  This Extended Limited Warranty must be purchased within 30 days of the original purchase to be effective under the provisions of this Agreement. 

b.  This Agreement extends the term of the original limited warranty and otherwise amends the original limited warranty as set forth herein. 

c.  Your original dated sales or delivery receipt showing the date of purchase is your proof of purchase.

d.  The extension periods apply based on the corresponding price that you pay for the Extended Limited Warranty outlined on npcwarranty.com and your Extended Limited Warranty proof of purchase.

2.  COVERAGE:

a.  This Extended Limited Warranty covers the same terms and conditions as the original limited warranty provided at the time of the product purchase.

b.  The Extended Limited Warranty is limited to defects in materials and workmanship under normal use by Customer, as well as Customer caused unintended damage.

c.  If a defect in materials or workmanship is discovered during the Extended Limited Warranty period, we will, at our sole option, repair or replace your product at no cost to you.

d.  This Agreement is only valid in the country in which the product was purchased.

3.  LIMITATIONS:

a.  The Extended Limited Warranty extends only to the original retail purchaser of this product and is not transferable to anyone who obtains ownership of the product from the original purchaser.

b.  The Extended Limited Warranty does not cover claims resulting from misuse, failure to follow the instructions, improper installation, improper maintenance, unauthorized repairs, abuse, alterations, modifications, involvement in an accident, and normal wear and tear.

c.  Provider's liability under this Extended Limited Warranty will not exceed the original purchase price of the product.

d.  Provider is not responsible for any incidental or consequential damages, including but not limited to, loss of use, loss of profits, or loss of data, whether in an action of contract, negligence, or other tortious action arising out of or in connection with the use or performance of the product.

e.  Provider is not liable for any claims regarding the aesthetic features of the product that do not affect its functionality.

f.  Provider is not liable for any failures or defects that are not reported within a specified period of 30 days after the defect or failure reasonably becomes apparent.

g.  The Extended Limited Warranty does not cover products which are used in rental operations and Provider will not be liable for any incidental or commercial damages relating to such use.

h.  The Extended Limited Warranty does not have a cash value.

i.  Customer must be in possession of the product at time of claim regardless of the reason for claim.

j.  TO THE GREATEST EXTENT PERMITTED BY LAW, THIS EXTENDED LIMITED WARRANTY IS EXCLUSIVE AND IN LIEU OF ANY OTHER WARRANTY, WRITTEN OR ORAL, INCLUDING BUT NOT LIMITED TO ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

k.  The duration of any implied warranties, including any implied warranty of merchantability or fitness for a particular purpose that may exist during the express warranty period are expressly limited to the extended limited warranty period.

l.  Some states and countries do not allow limitations on how long an implied limited warranty lasts; therefore, the above limitation and exclusions may not apply to you.

m.  Some states do not allow the exclusion of limitation of incidental or consequential damages, so the above limitation of exclusion may not apply to you.

4.  CLAIMS PROCEDURE:

a.  To obtain service under this Extended Limited Warranty, Customer must notify Provider of the defect within the extended warranty period, as otherwise required under the provisions of this Agreement, and comply with Provider's claim procedures.

b.  Provider reserves the right to inspect the product and determine the appropriate course of action, which may include repair, replacement, or refund at Provider's sole discretion.

5.  DISPUTE RESOLUTION:

a.  Customer and Provider must first attempt resolution of any disputes arising under this Agreement via email communications at support@npcwarranty.com.

b.  Customer or Provider may only file a lawsuit after 60 days of good faith attempts at resolution of any disputes under this Agreement.

6.  REMEDY:

a.  CUSTOMER'S EXCLUSIVE REMEDY FOR BREACH OF THIS EXTENDED LIMITED WARRANTY OR OF ANY IMPLIED WARRANTY OR OF ANY OTHER OBLIGATION ARISING BY OPERATION OF LAW OR OTHERWISE SHALL BE LIMITED AS SPECIFIED HEREIN TO REPAIR OR REPLACEMENT, AT OUR SOLE OPTION.

b.  IN ANY EVENT, RESPONSIBILITY FOR SPECIAL, INCIDENTAL AND CONSEQUENTIAL DAMAGES IS EXPRESSLY EXCLUDED.

7.  GOVERNING LAW AND JURISDICTION:

a.  This Agreement is governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any choice of law or conflict of law provisions.

b.  Any legal suit, action, or proceeding arising out of, or related to, this Agreement must be filed exclusively in the Circuit Court of Cook County, Illinois or the Federal District Court for the Northern District of Illinois, Eastern Division.

c.  Provider and Customer consent to the jurisdiction of such courts and waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts.

8.  GENERAL PROVISIONS:

a.  The terms of this Extended Limited Warranty, including the tiered pricing and duration, are subject to change by Provider without prior notice, except as prohibited by law.

b.  Provider reserves the right to discontinue the Extended Limited Warranty any time without notice, provided that any extended limited warranties already purchased will be honored for the stated duration.

c.  Provider reserves the right to require Customer to provide proof of maintenance or use in accordance with the product's instructions as a condition for coverage under this Extended Limited Warranty.

d.  This Extended Limited Warranty gives Customer specific legal rights, and Customer may have other rights that vary from state to state or country.

e.  Provider’s failure or delay in enforcing any provision in this Agreement will not be deemed a waiver.

f.  If any provision of this Agreement is held by a court or other tribunal of competent jurisdiction to be illegal, invalid or unenforceable, such provisions will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
